YOU HAVE CONSTITUTIONAL RIGHTS  — 

All people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution…

DO NOT OPEN THE DOOR if an immigration agent is knocking on the door 

Response: “I do not give you permission to enter my home based on my 4th Amendment rights under the United States Constitution unless you have a warrant to enter, signed by a judge or magistrate with my name on it that you slide under the door. I do not give you permission to search any of my belongings based on my 4th amendment rights.

DO NOT ANSWER ANY QUESTIONS from an immigration agent if they try to talk to you. You have the right to remain silent.

Response: “I do not wish to speak with you, answer your questions, or sign or hand any documents based on my 5th Amendment rights under the United States Constitution.”

DO NOT SIGN ANYTHING without first speaking to a lawyer. You have the right to speak with a lawyer

Response: “I do not wish to sign anything without first consulting my lawyer. I chose to exercise my constitutional rights.” 

 

CONSTITUTIONAL AMENDMENTS TO PROTECT YOU: 

4th amendment - “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

5th amendment - “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation”

IMPORTANT REMINDERS

• You have the right to access emergency medical care. Federal laws and regulations ensure the rights of all people to access emergency medical care, including undocumented immigrants.
• State and local law enforcement cannot ask for your immigration status. California law expressly prohibits law enforcement from inquiring about a person's immigration status for immigration enforcement purposes.
• State and local law enforcement cannot share your personal information. This includes sharing your home or work address for immigration purposes unless that information is available to the public or unless that information involves previous criminal arrests, convictions, or similar criminal history.
• State and local law enforcement cannot assist ICE with immigration enforcement, with very limited exceptions. This means they cannot investigate, cannot interrogate, cannot arrest, and cannot detain you unless it is part of a joint federal task force where the primary purpose is not immigration enforcement.
• Confidentiality of Personal Information: Federal and state laws protect student education records and personal information. These laws generally require that schools obtain written consent from parents or guardians before releasing student information, unless the release of information is for educational purposes, is already public, or is in response to a court order or subpoena.

NO ABRA LA PUERTA si un agente de inmigración está tocando a la puerta

Responda: «No le doy permiso de entrar a mi casa sobre la base de mis derechos bajo la 4ª Enmienda de la Constitución de los Estados Unidos, a menos que tenga una orden para entrar, firmada por un juez o magistrado con mi nombre en ella y que pueda deslizar por debajo de la puerta. No le doy permiso para revisar ninguna de mis pertenencias basándome en mis derechos de la 4ª Enmienda».

NO CONTESTE A NINGUNA PREGUNTA de un agente de inmigración si intenta hablar con usted. Tiene derecho a permanecer en silencio. 

Responda: «No deseo hablar con usted, responder a sus preguntas, ni firmar o entregar ningún documento basándome en mis derechos de la 5ª Enmienda de la Constitución de los Estados Unidos».

NO FIRME NADA sin hablar antes con un abogado. Tiene derecho a hablar con un abogado

Respuesta: «No deseo firmar nada sin consultar antes con mi abogado. He optado por ejercer mis derechos constitucionales». 

 

ENMIENDAS CONSTITUCIONALES PARA PROTEGERTE:

4ª Enmienda - «No se violará el derecho del pueblo a la seguridad de sus personas, domicilios, documentos y efectos personales, contra registros e incautaciones irrazonables, y no se emitirá ninguna Orden Judicial, salvo por causa probable, apoyada por Juramento o afirmación, y describiendo en particular el lugar a registrar y las personas o cosas a requisar».

5ª Enmienda - «Ninguna persona podrá ser condenada a responder por un delito punible con la pena capital o por cualquier otro delito infamante, a menos que medie una acusación formulada por un Gran Jurado, salvo en los casos que se presenten en las fuerzas terrestres o navales, o en la Milicia, cuando estén en servicio activo en tiempo de guerra o de peligro público; Nadie podrá ser sometido dos veces por el mismo delito a peligro de muerte o de integridad física; nadie podrá ser obligado en una causa penal a declarar contra sí mismo; nadie podrá ser privado de la vida, la libertad o la propiedad sin el debido procedimiento legal; nadie podrá ser privado de la propiedad privada para uso público sin una compensación justa».

RECORDATORIOS IMPORTANTES: 

• Tienes derecho a obtener atención médica de emergencia. Las leyes y regulaciones federales garantizan el derecho de todas las personas a acceder a atención médica de emergencia, sin a pesar su estatus migratorio. 
• Las autoridades estatales y locales no pueden preguntarle su estado migratorio. La ley de California prohíbe expresamente a las autoridades preguntar sobre el estatus migratorio de una persona con fines de control de imigración. 
• Las autoridades estatales y locales no pueden compartir su información personal. Esto incluye compartir la dirección de su casa o trabajo con fines de inmigración, a menos que esa información esté disponible para el público o a menos que esa información involucre arrestos penales previos, condenas, o antecedentes penales similares. 
• Las autoridades estatales y locales no pueden ayudar a ICE con el control de inmigración, con excepciones muy limitadas. Esto significa que no pueden investigar, interrogar, arrestar ni detenerlo a menos que sea parte de un grupo de trabajo federal conjunto cuyo propósito principal no sea el control de la inmigración.
